Legal writing tip of the day

The words "this case is an exemplar of [whatever you're arguing]" should never appear in your brief.

If it is, there's no need to say it.

"If I were a law professor and describing the prototypical case for [some proposition], I would use this case."

Umm... no.

3 little fish:

  1. Oh! Oh! This should be a recurring feature! I have LOADS of things to contribute.

  2. YIKES~ That's as bad as saying "clearly" or "Defendant was the most negligent person EVER" ha ha ha!

  3. I have officially made exemplars of bad legal writing an official 'label' of the blog. These posts will be filed under "i'm no bryan garner but..."
